When talking about personal bankruptcy, most people picture multi-million bank loans. As a result, thousands of people who do not have huge bank loans are overlooked, despite suffering from unbearable utility debts, back taxes, or a web of dozens of microloans with insane interest rates.
The main misconception held by residents of Oryol and the surrounding region: "Is it really possible to write off debts owed to the state or a utility provider? It is not a bank!".
Our answer is clear: yes, you can. Federal Law No. 127-FZ "On Insolvency (Bankruptcy)" makes no distinction between a commercial bank and your local utility company. Let us break down each debt category in detail.
It often happens: someone loses a job or falls ill, making utility payments impossible. Within a couple of years, the debt grows to hundreds of thousands of rubles. Next come lawsuits, court bailiffs, frozen bank accounts, and threats to shut off power or water.
How it is discharged: In bankruptcy, all utility debts accumulated prior to court approval of the application are completely discharged. You are freed from past liabilities, including interest and penalties. Your account is reset, allowing you to pay utilities with a clean slate.
Important detail: If the apartment is jointly owned (e.g., with a spouse or relatives), utility debt is considered joint liability. To completely discharge it for the entire property, property shares must be correctly allocated, or joint bankruptcy filed.
This includes personal transport, property, or land tax liabilities. However, former individual entrepreneurs (IP) face this issue most frequently. The business is closed, yet fixed social fund and tax contributions continue accruing.
How it is discharged: The Tax Service is a creditor like any other. Law No. 127-FZ allows full discharge of taxes, insurance contributions, and penalties. You can file as an individual or active sole proprietor (in which case sole proprietor status closes automatically during court proceedings).
Microfinance organizations represent the most aggressive lending environment. Someone borrows 10,000 rubles until payday, cannot repay on time, and takes another loan to cover the first... Soon they have 20–30 open loans, and total debt skyrockets to half a million rubles. Debt collectors call constantly.
How it is discharged: Microloans are written off standardly and in full. Once proceedings are initiated, MFIs are legally barred from adding interest, fines, or penalties, and debt collectors are prohibited from calling.
The law is strict, and not everything can be written off. Bankruptcy does not discharge obligations inextricably tied to the debtor’s person:
It does not matter whom you owe — a bank, tax authority, microfinance company, or water utility. If total debts exceed 300,000–500,000 rubles and you cannot pay, you have a legal right to discharge this burden. Proper analysis of your debt structure before filing with the Orel Oblast Arbitration Court is essential.
From the moment bankruptcy is introduced by the arbitration court, utility companies are legally required to suspend all service cutoffs for past debts.
Utility charges accrued after the official filing date are considered current payments and must be paid on time, as bankruptcy does not discharge them.
Yes. If sole proprietorship was liquidated and accrued debts were transferred to you as an individual, they are fully subject to discharge in general bankruptcy proceedings.
The total number of microloans or MFIs does not matter. The entire creditor list is included in the bankruptcy application, discharging all principal and interest at once.
| Debt Type | Discharged? | Note |
|---|---|---|
| Utilities (water, electricity, overhaul) | YES | All debts accrued before procedure introduction |
| Taxes (FNS, transport, sole proprietor) | YES | Including pension contributions and penalties |
| Microloans (MFIs) and loans | YES | Full cancellation of principal and interest |
| Alimony and health damages | NO | Obligations tied to the debtor’s person |
