When debts reach the court, patience runs out. Court bailiffs appear at your doorstep, and the phone rings off the hook. Many fear filing for bankruptcy, thinking it will only get worse. But is that true? Let us compare the real state of affairs.
The fundamental difference is that bailiffs act in the interest of banks and will drain money from you indefinitely. Bankruptcy under Federal Law No. 127 is designed to resolve the situation once and for all, fully discharging your debts.
To make it easier to evaluate the difference, we prepared a clear table showing what happens to your rights, money, and property in both scenarios.
| Legal Aspect | Enforcement Proceedings (FSSP, Federal Law No. 229) | Bankruptcy Proceedings (Arbitration Court, Federal Law No. 127) |
|---|---|---|
| Interaction with Creditors | Collection agencies and credit organizations continue pre-trial and extrajudicial communications under Federal Law No. 230. | Full moratorium. Under Art. 126 of Federal Law No. 127, all direct contact between creditors/collectors and the debtor is strictly prohibited. |
| Income Deductions | Up to 50% (in certain cases up to 70%) of official salary or pension until the total debt amount is fully covered. | The financial trustee pays out the subsistence minimum for the debtor and dependents. Medical expenses and utility bills can also be excluded from the estate by court ruling. |
| Status of Primary Residence | Property immunity under Art. 446 of the Civil Procedure Code applies, but the bailiff has the right to impose restriction bans on title registration. | The primary residence (excluding mortgaged properties) is fully exempt from forced execution and remains with the owner. |
| Travel Restrictions Outside the RF | Imposed by bailiff order for debt balances starting at 30,000 RUB (or 10,000 RUB for child support obligations). | In the practice of the Orel Region Arbitration Court, temporary travel bans are applied exclusively upon proven creditor motions of debt evasion. In 95% of cases, no restriction is imposed. |
| Final Outcome | Accrual of fines, interest, and a 7% enforcement fee. The debt remains with the citizen for life and is inherited. | Full discharge of obligations. The arbitration court issues a ruling on completing the procedure and discharging debts. |
In the event of insolvency, citizens face a choice: spend years under pressure from enforcement proceedings by the Federal Bailiff Service (FSSP) or utilize judicial bankruptcy under Federal Law No. 127-FZ "On Insolvency (Bankruptcy)". Below is a legal overview of the consequences and limitations of both mechanisms.
The primary difference lies in the objective of the legislation. Federal Law No. 229-FZ "On Enforcement Proceedings" aims at forced execution of judicial acts in favor of creditors. Bailiffs' activities have no timeframe for full debt write-off: enforcement proceedings can be closed under Art. 46 Part 1 Item 4 and reopened by creditors an unlimited number of times.
In contrast, personal bankruptcy (Federal Law No. 127-FZ) aims to fully discharge the citizen from unbearable liabilities within fixed procedural deadlines (averaging 6 to 8 months).
It is vital to understand that during judicial bankruptcy, a citizen receives official protection from the arbitration court. Bailiff orders seizing bank accounts and personal property must be canceled once the court decides to introduce debt restructuring or asset liquidation.
Regulatory Basis: According to Art. 69.1 of Federal Law No. 229-FZ, upon receiving a copy of the arbitration court ruling declaring a citizen bankrupt, the bailiff is required to suspend or terminate enforcement proceedings.
Under Russian family law, property acquired during marriage is joint property. When joint property is liquidated, the spouse receives 50% of its value. However, property received via gift, inheritance, or acquired before marriage is not subject to sale or seizure.
If the car is the sole source of income (e.g., official transport employment) or required by the debtor/dependents due to disability, the attorney can petition the Arbitration Court to exclude the vehicle from the bankruptcy estate under Art. 446 of the Civil Procedure Code.
As shown in the table, bankrupt status is not a loss of rights, but a legal shield. As soon as the Orel Region Arbitration Court accepts your petition, all bailiff enforcement proceedings are frozen. Accounts are no longer drained to zero, and seizures are lifted.
Important Fact: Bailiffs can pursue you for years, pass debt to heirs, and disrupt your children's lives. Bankruptcy takes an average of 6–8 months, after which you are free.
